A RESOLUTION REQUESTING THE COUNTY AUDITOR TO CERTIFY TO THE VILLAGE INFORMATION NEEDED TO ENABLE THE VILLAGE
TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION,
IN THE AMOUNT OF 1.1 MILLS FOR THE INFRASTRUCTURE MAINTENANCE FUND, AND TO DECLARE AN EMERGENCY
The Council of the Village of Riverlea, Franklin County, Ohio, met in regular session on the 19th day of May, 2025, with at least two-thirds of the members of Council being present.
moved the adoption of the following resolution:
WHEREAS, pursuant to Ohio Revised Code Section 5705.03(B), the Council of the Village of Riverlea has determined that it is necessary to levy a tax outside the ten-mill limitation for the purpose of infrastructure maintenance funding for the Village, and desires to obtain from the Franklin County Auditor a certification of the total current tax valuation of the Village and of the dollar amount of revenue that will be generated by a 1.1 mill levy within the Village;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF RIVERLEA, STATE OF OHIO, AT LEAST TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING:
Section 1. That the Village does hereby certify to the County Auditor of Franklin County, Ohio, this Resolution and requests that the County Auditor certify to the Village of Riverlea and its Council the total current tax valuation of the Village and the dollar amount of revenue that would be generated by the specified number of mills set forth below based on the following information:
Purpose of the tax: Infrastructure Maintenance Fund
Type of tax: Replacement of 1.5 mills to constitute a 1.1 mill levy
Authorization for levy: Ohio Revised Code Section 5705.19(A)
Term: 5 years, commencing in 2025, first due in calendar year 2026
Section 2. That the Clerk-Treasurer of the Village be and hereby is directed to submit a copy of this certification to the County Auditor of Franklin County, Ohio.
Section 3. That this Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Resolution were taken in an open meeting of this Council and that all deliberations of this Council that resulted in those formal actions were in meetings open to the public in compliance with law.
Section 4. Emergency; Effective Date. That this Resolution is declared to be an emergency measure, effective upon passage, and immediately necessary for the preservation of the health, peace, safety and welfare of the residents of the Village of Riverlea. Such emergency exists in the Village because the information needs to be obtained from the County Auditor for the bond issue to proceed in a timely fashion. Accordingly, this Resolution shall be in full force and effect from and after the earliest date permitted by law after its passage.
Section 5. That this Resolution shall be in full force and effect immediately upon its passage.
