An Ordinance Levying an Annual License Tax Upon The Operation of Motor Vehicles on the Public Roads or Highways Pursuant to Section 4504.172 of the Ohio Revised Code

Introduced by Mr. Hamor

WHEREAS, the General Assembly of the State of Ohio has enacted Section 4504.172 of the Ohio Revised Code whereby municipal corporations are empowered to levy an annual license tax upon the operation of motor vehicles on the public roads and highways at the rate of Five and 00/100 Dollars ($5.00);

WHEREAS, the Village Council of the Village of Riverlea, Ohio, has determined that funds available for the operation and maintenance of its streets and roads in the future likely will be insufficient by reason of other operational demands on its funds, and so has indicated its desire to levy the tax authorized by Section 4504.172 of the Ohio Revised Code for the purposes of paying the costs and expenses of enforcing and administering the same, and to provide additional revenue for the purposes set forth in Section 4504.06 of the Ohio Revised Code, and to supplement the revenue already available for said purposes;

Now, therefore, be it ordained by the Council of the Village of Riverlea, State of Ohio, a majority thereof concurring:

Section 1.

  1. That for the purposes of paying the costs and expenses of enforcing and administering the tax levied hereunder, to supplement the revenue already available to the Village of Riverlea, Ohio, under Sections 4504.04, 4504.06, 4504.17, or 4504.171 of the Ohio Revised Code, and to provide additional revenue for the purposes set forth in those Sections, there is hereby levied upon the operation of motor vehicles on the public roads or highways of the Village of Riverlea, Ohio, pursuant to Section 4504.172 of the Ohio Revised Code, an additional license tax in the amount of Five and 00/100 Dollars ($5.00) per motor vehicle on all motor vehicles the district of registration of which is the Village of Riverlea, Ohio, which shall be in addition to the taxes at the rates specified in Sections 4503.04 and 4503.16 of the Ohio Revised Code, if any, and subject to reductions in the manner provided in Sections 4503.11 of the Ohio Revised Code, and the exemptions provided in Sections 4503.16, 4503.17, 4503.171, 4503.41, and 4503.43 of the Ohio Revised Code;
  2. That for the purposes of this ordinance the term “motor vehicle” shall have and be afforded the same meanings included within the definition of said term in Sections 4501.01 and 4505.01 of the Ohio Revised Code;
  3. That the tax levied and imposed by this ordinance shall apply to, and be in effect for the registration year commencing on January 1, 2014, and shall continue in full force, effect and application during each registration year thereafter until repealed by appropriate legislative action;
  4. That the tax levied and imposed by this ordinance shall be paid to and collected annually as to each motor vehicle to which the same is applicable by the Registrar of Motor Vehicles of the State of Ohio, or to a Deputy of the same, at the time the application for registration of each such motor vehicle is made as provided by Section 4503.10 of the Ohio Revised Code; and
  5. That all of the moneys derived from the tax levied and imposed by this Ordinance will be utilized for such purposes and in such manner as the Village Council of the Village of Riverlea, Ohio, may determine, but only for the purposes, and in the manner specified herein, and only as allowed by law.

Section 2. That the Clerk-Treasurer of the Village of Riverlea, Ohio, is hereby authorized, and directed to forward to the Ohio Bureau of Motor Vehicles an executed and certified copy of this ordinance after the passage and effective date thereof.

Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting in compliance with Section 121.22 of the Ohio Revised Code.

Section 4. This Ordinance is subject to referendum as provided in Sections 731.29 to 731.41, Ohio Revised Code.

Section 5Publication. That pursuant to Ohio Revised Code Section 731.25, the Council of the Village of Riverlea hereby determines that publication of this Ordinance in a newspaper is unnecessary and does hereby determine that this Ordinance shall be published by posting copies hereof in the five following places which are determined to be the five most public places in the Village of Riverlea, Ohio:

  1. The Circle on West Riverglen Drive.
  2. The Ravine Park on West Riverglen Drive.
  3. The Northwest corner of Beverly Place and Dover Court.
  4. Lot 75 on West Riverglen Drive.
  5. Lot 7 on West Southington Avenue.

Copies of this Ordinance shall be posted continuously in the above-mentioned places for a period of fifteen (l5) days.Passed this 18th day of June 2012.
